Short Sales

Due to the  economic down turn over the last few years, real estate short sales are becoming increasingly more frequent along with being more acceptable as a method to deal with real estate that is "underwater" or not valued as much as the liability or loan which is owned. 

A short sale occurs when a property is sold and the lender agrees to accept a discounted payoff, meaning the lender will release the lien that is secured to the property upon receipt of less money than is actually owed.  If an unpaid balance of a loan is $250,000 and the real estate is now valued at $200,000, in a short sale scenario, the lender could accept the market value of the real estate as payment in full for the outstanding loan of $250,000.  Of course there may be tax consequences involved should the lender accept a payoff of the loan for something less than what is owed.  We would advise any person or entity interested in selling their property via the above scenario to consult with a tax advisor before listing your property.
